1. ABOUT US
OneDayRentals(“we”, “us”, “our”) operates an online marketplace platform.
We act solely as an intermediary and do not own, hold, or directly supply any items listed on the Platform unless expressly stated.
2. DEFINITIONS AND INTERPRETATION
Business Seller: a user acting in the course of business.
Consumer Seller: a Business Seller where consumer law applies.
Private Seller: a user not acting in the course of business.
Buyer/Renter: a user purchasing or renting Items.
Platform Services: facilitation, listing, payment processing, and related services.
3. SELLER CLASSIFICATION (B2C / C2C)
Business Sellers are subject to the Consumer Rights Act 2015, Consumer Contracts Regulations 2013, and all applicable consumer protection law.
Private Sellers are not generally subject to consumer statutory obligations but must not misrepresent Items.
The Platform may classify or reclassify users where reasonable grounds exist.
4. PLATFORM ROLE
The Platform enables users to list, discover, rent, and purchase items.
We do not own, inspect, or guarantee items listed.
Contracts are formed directly between users.
We take reasonable steps to monitor and remove misleading or unlawful listings.
Nothing in these Terms limits statutory rights.
5. USER RESPONSIBILITIES
Users must provide accurate and truthful information.
Users must act in good faith and communicate respectfully.
Users must comply with agreed rental and return terms and applicable laws.
6. LISTINGS
Sellers must provide accurate descriptions, images, and material information.
Sellers must not mislead or omit key information.
We may remove listings or suspend accounts where necessary.
7. PAYMENTS
Payments must be made via approved methods.
We may charge fees or commission, disclosed before checkout.
Payments must be completed before dispatch unless agreed otherwise.
8. SECURITY DEPOSITS
A refundable deposit is required for rentals.
Deposits are held as security for damage, loss, or breach.
Deposits are returned within 3–5 working days after review.
9. RETURNS AND REFUNDS
Items must be returned within agreed rental periods.
Users must use tracked delivery.
Consumer law may apply where sellers are acting in business.
10. DEPOSIT DEDUCTIONS
Deposits may be retained for late return, damage, non-return, or alteration.
Deductions must be reasonable and proportionate.
11. NON-RETURN OF ITEMS
Full deposit may be retained.
Further recovery action may be taken.
12. SHIPPING AND DELIVERY
Sellers dispatch items.
Buyers return items.
We are not liable for courier delays, loss, or damage.
13. CONSUMER RIGHTS AND CANCELLATION (BUSINESS SELLERS ONLY)
Where Business Sellers transact with Consumers, statutory cancellation rights may apply under the Consumer Contracts Regulations 2013.
A 14-day cooling-off period may apply unless exemptions are met.
Business Sellers are solely responsible for compliance with applicable consumer law obligations.
14. DISPUTE RESOLUTION FRAMEWORK
Users must first attempt good faith resolution.
Disputes must be raised within 48 hours of receipt or end of rental period.
The Platform may require supporting evidence including photographs, correspondence, and proof of delivery.
The Platform may (but is not obliged to) make determinations regarding fund allocation.
Platform determinations are administrative and without prejudice to legal rights.
15. LIABILITY AND LIMITATIONS
Nothing excludes liability for death or personal injury caused by negligence, fraud, or statutory non-excludable rights.
The Platform excludes liability for user-generated content, listings, and transactions to the fullest extent permitted by law.
The Platform shall not be liable for indirect, consequential, or economic loss including loss of profit or goodwill.
The Platform’s aggregate liability shall be limited to fees received in the 12 months preceding the claim.
16. INDEMNITY
Users agree to indemnify the Platform against all claims arising from:
– Misrepresentation or breach of listing obligations
– Breach of applicable law
– Disputes between users
17. FRAUD, SANCTIONS AND ENFORCEMENT
The Platform may suspend accounts, freeze funds, and report suspected fraudulent activity to authorities or payment providers.
The Platform may cooperate with regulators and law enforcement.
18. SUSPENSION AND TERMINATION
The Platform may terminate or suspend access immediately for breach or risk management reasons.
19. DATA PROTECTION
Personal data is processed in accordance with UK GDPR and Data Protection Act 2018.
Users may exercise statutory rights including access, rectification, and erasure.
20. ACCEPTABLE USE
Users must not engage in unlawful activity, fraud, impersonation, or listing prohibited items.
21. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
